Yet Another Person Drugged Against Their Will

Anesthesiology - Sedation & General Anesthesia without consent

Expert: Ronald Levy, M.D. - 11/20/2009

QUESTION: On October 19, 2009, I had TriVex surgery to correct Varicose veins in my leg. I consulted with the surgeon before even being a candidate for surgery and asked for a regional anesthetic. The surgeon said that would be too much anesthesia and suggested spinal anesthesia. I said I wanted to remain awake and not be sedated and wanted to have a similar experience as I did
during the C-Section birth of my child. The surgeon agreed. This is well documented in my medical record. The day of surgery I spoke with the first nurse who started my IV and told her that I was going to be awake because I was having spinal anesthesia. The nurse checked my medical record and said “You're right, you‘re having a spinal". I then consulted with the anesthesiologist, who said that he was going to put medicine in my IV to make me go to sleep. I told him no you’re not, I am having a spinal. The anesthesiologist said, ”Who says“? I told him my surgeon and I also said, “I want to be awake“. He confirmed that I was having spinal anesthesia in her medical record. The surgeon came in and marked my leg and I asked him if I could watch the procedure. He said no. The nurse anesthetist then came into the room and I told her that I wanted to be awake and made reference to my experience during child birth. I went to the operating room at 10:00 A.M. and at 10:02 A.M. the nurse anesthetist administered 1.5 mg of Midazolam and I weigh 112 pounds. The anesthesiologist told the nurse anesthetist give her ____ she is allergic to Morphine. The nurse anesthetist said I am. The last thing I remember, is the nurse anesthetist putting up a curtain near my waist and I said, “Well I guess I won‘t be able to watch“. I woke up 50 minutes later and discovered that I had been put to sleep against my consent. According to my medical record, the spinal was in at 10:09 A.M. and right after that it says Propofol was administered. TriVex is a new “minimally evasive procedure“. I also talked with a medical doctor about this incident and he said, “It is highly unlikely they gave you Propofol for varicose veins”, but it is in my medical records and they agree they gave me Propofol. On the pre-anesthesia report it says, "Patient wants SAB" spinal anesthesia and the block for Versed is not checked. All documents in my medical record list spinal and nothing else. The next day I complained to the surgery center saying that they sedated me and put me to sleep without my consent. The head nurse said they give the Midazolam because they don't want people to hear noises. The nurse anesthetist then called and I complained to her. The nurse anesthetist said she gave the Midazolam so I did not hear noises because it is too traumatic on people. I then asked why they did a spinal and used propofol and the nurse anesthetist said, “You were moving your leg“.
During a follow up visit with the surgeon he apologized and said he does not know why they sedated me. He said there were some "Oohs and Aw's" so they used propofol. The surgeon said he could have performed the surgery with only spinal anesthesia and no sedation as planned. I also got a letter from the administrator of the surgical center saying that he spoke with the anesthesia team and they agreed I wanted to be awake and apologized. I see from many articles that Midazolam is a pre-medication for Propofol. Based on the dose of Midazolam did they intend on administering Propofol all along and did the spinal to appease me and said that they tried the spinal anesthesia? I never agreed to anything other than spinal anesthesia without sedation. Why didn't they administer the spinal anesthesia and if not successful, tell me that they would have to put me to sleep? Since I am in Pennsylvania, I filled out private criminal complaints against the anesthesiologist and nurse anesthetist and have an appointment with the prosecutor on November 30, 2009, to see if he will accept the criminal charges. These acts were intentional and deliberate and I feel they violated criminal law and have alleged in the charges that they provided drugs as a practitioner beyond the scope of their authority and without my consent. Could you please answer my questions so I am clear on everything.

ANSWER: Let me try to answer your question understanding that I have to speak about the hypotheticial since I was not present for your procedure. I will try to address all of your concerns.

First some definitions. Midazolam is a anxiolytic (like Valium but shorter acting) that, in addition to its anti-anxiety effects, also has amnestic effects. Propofol is an anesthetic, but in smaller doses, is a sedative, anxiolytic and also has some amnestic properties. MAC (monitored anesthesia care) anesthesia can mean anything from no drugs at all to as much drugs as possible so long as the patient is arousable. Spinal anesthesia is a regional anesthesia technique. I assume you had the spinal done (a needle in the back). The anesthesiologist, as part of his consent, should have mentioned that there is always a possibility that the spinal may fail and they'd have to convert to general.

The procedure you had was likely done under spinal (SAB) but they did give you the Versed for the anti-anxiety properties (1.5 mg is not a large dose). While spinal anesthetics are very reliable, they don't always work and we sometimes have to supplement them when they only partially work. The easiest way to do this (while still giving a MAC anesthetic) is to use propofol. The sedative effects of Propofol along with the partially working SAB is usually enough to finish the procedure. If that fails, then general anesthesia is the only option. If your anesthetic record does not note either an endotracheal tube or an LMA, then you did not have a general anesthetic. Midazolam is not a premed for Propofol but rather an anxiolytic usually given before entering the OR. I speak from experience in that I have had wisdom teeth taken out under Midazolam and although the dentist (a friend) said I moaned and groaned, I have no memory (thankfully) of the procedure. There is no indication that they intentionally put you to sleep and I can't imagine an anethesiologist putting in a spinal just for show. In fact, anesthesiologists prefer regional anesthesia because patients can tell us if they are having chest pain, etc so it is easier to treat them. The difference between this procedure and your c-section is that for your section they wanted you to remember holding your baby for the first time so they didn't give you the Midazolam. Most anesthesiologists are hesitant to agree to a completely awake patient primarily because many patients think they want to be awake but when they get to the OR and they hear the noises and see the blood, etc. they aren't so happy any more but now the anesthesiologists hands are tied and he can't give sedation (even though you are awake and now ask for it, you are under stress and the validity of your consent may have some medicolegal implications later on).

You are certainly free to pursue legal action but my feeling is the prosecutor will be reluctant to accept the case as he will have a small chance of a conviction (if what I have said is true).

QUESTION: Dr. Levy don't you see a problem with informed consent? I specially told every medical employee (I will not call them professionals) that I came in contact with that I was only consenting to a spinal with no sedation and I wanted to be awake like I was during the birth of my child, which would include not consenting to amnesia from Midazolam. After I complained, all medical employees agreed that I wanted to be awake and apologized. I never agreed to any type of sedation, either Midazolam or Propofol or any other sedative. I was given the Midazolam and then told. Don't you see a problem with consent there? According to proper informed consent in Pennsylvania I was suppose to be told of the risks and benefits of the anesthesia. I was never advised of any risks or benefits and alternatives of any anesthesia, let alone the spinal. You don't see an ethical issue here? If you took you vehicle in for an oil change and a hour later the mechanic spoke with you and told you that your bill would be $1,200 because while it was on the lift they had to put a new transmission in and did not it without your consent. The mechanic is an expert in his field like doctors are experts in the medical field. I am sure you would be highly upset with your mechanic and that issue could be dealt with either in civil court or the mechanic could be arrested for fraud or deceptive business practices, which would be handled by the criminal justice system. This is the same issue, I did not consent to anything other than the spinal and consented to and agreed to be fully awake since I was consenting to a spinal only. They did not have a right to sedate (Midazolam) me against my will and without my consent or permission. Also I see that people who are allergic to eggs can have an allergic reaction to Propofol. They never checked this with me. It certainly seems that doctors and other medical employees do not have have ethics and feel that they can do whatever they want to their patients without being held accountable. Can you name any other profession where employees could treat the consumer like I was treated and not be held accountable or disciplined? All of this comes from someone who has worked as a medical professional for over 25 years. I appreciate your response.

As I stated in my previous response, I was not justifing what they did, I was only commenting on what likely happened. I do take offense when you say doctors and medical personnel do not have ethics, etc, based on this one event you had. Let me try to answer some of your comments and ask you a question. As for the consent, if they did not talk to you at all about the type of anesthesia, risks, complications and alternatives, then they were clearly wrong (not just in PA but throughout the world). With respect to eggs and Propofol, they should have certainly asked if you had any allergies (I'm sure someone asked you that question) and the problem with eggs has to do with the yolk and some recent studies have shown that the formulation of Propofol doesn't have the proteins common in the allergy ( but they still should have asked and many anesthesiologists probably wouldn't use it. As for other professions where employees take advantage, I think every profession has people who do that. There are bad apples everywhere but it should not speak against all people in that profession. As for suing them, you are certainly within your rights to do that. I don't think you have grounds for a malpractice suit (you don't meet the 3 criteria). A criminal suit would be tough to get a conviction (the best charge might be battery but it would be hard to prove) so your only hope would be a civil suit which may get you money but I don't think that is what you want. You could certainly notify your state medical board and they can investigate (which is probably the right thing to do) but that is up to you.

As for my 2 questions, the first is "Why are you so insistent to be awake for the procedure?" and the second and more important question is "What would you want the anesthesiologist to do if he did only the spinal and it didn't work or it did work but you had second thoughts and were now nervous and wanted sedation?". As I mentioned earlier, the only "legal" option you give the surgeon and anesthesiologist is to abort the procedure (if possible) and come back another time.

Doctor Hater? Well, no...

I am not a Doctor hater! As you read this blog, it may seem so. However, nothing could be further from the truth, at least BEFORE this debacle. My former step father is a Doctor of internal medicine in San Jose, Ca. I love him dearly as well as his new wife. My sister works for him in his office and I myself have worked in his office. We kept him after the divorce, although I would hate for my mom to find out that I am still friends with him!

The surgeon who performed the 4 open reductions on my femur when a horse kicked it clean in 2 back in 1986 is truly a wonderful man. His name is Dr. Paul David Levin, retired. I developed rotational instability twice which needed to be corrected. At no time did Dr. Levin doubt my words. His entire staff was kind and caring even though I was a difficult patient. (I tried to do too much after the surgeries, which may have contributed to the second rotational instability and I couldn't deal with casts.)

When I just couldn't face another general anesthetic both Dr. Levin and the anesthesiologist were more than happy to have me awake. In fact the anesthesiologist (that's right, a DOCTOR NOT A GLORIFIED NURSE) was relieved that I had broached the subject of being awake myself as he wasn't sure how I would take it... They had so much trouble with me under general anesthetic that nobody wanted to work on me and this particular Doctor was the only one who would do it. This was all before Versed became the drug of choice.

These kind Doctors went so far as to put up mirrors so that I could watch without craning around to see what was happening. No surgical drape. I need to know what happens to me. I heal better, faster etc. This is a proven fact and my Doctor marveled at how fast I healed up after the 3rd surgery when I was awake and aware. He called it astonishingly exuberant bone growth, which had been lacking after the previous 2 surgeries.

When I had to have an arthroscope procedure due to knee injury from this accident, they also had a screen up so I could watch the little drill thingy zip around taking out the stalactites or stalagmites under my knee cap. I had this done at the same time they took out all the pins, nails, screws and plates. Since medical people are now saying that the SOUNDS of an operating room are traumatic, let me say this; the sounds of the drill, the sounds of something like a clam opening, a wet popping noise etc. the sounds of the drill, were not alarming in the slightest bit. There is no need for Versed so that we don't HEAR the surgery.

Likewise I heard the entire surgeries on my femur, the drilling, the slide hammer, the wet noises, as well as the crunch of the nippers biting out a chunk of my iliac crest for a bone graft... The conversations were pleasant and I spent most of the time talking to my anesthesiologist about what was coming next, why they were doing it, how was the weather, what all my horse was doing, the anesthesiologist's airplane, just all kinds of interesting subjects. Nothing scary or traumatic about any of it. I could ask the anesthesiologist to give me more or less drugs depending on what level of pain was acceptable, and at the end I had him taper down the drugs, allowing more pain, so that I could get out of recovery faster. I was starving after 12 hours of surgery and couldn't wait to eat. The anesthesiologist explained that Domino's Pizza couldn't go through the autoclave...

What WAS upsetting to hear were the nasty comments made about me in the operating room when my so-called caregivers had knocked me on my keester with Versed in 2006. They imagined that I would have amnesia and were very candid about their opinion of truck drivers, my physicality etc. I was horrified and this probably contributed somewhat to my PTSD. I have never heard such snide comments in my life. They were all laughing at my expense. Since I had no idea that I was supposed to have amnesia this was quite a shock. I couldn't BELIEVE what I was hearing! I couldn't speak coherently or defend myself in any way, I was unable to leave etc. completely helpless. These were the people that were going to knock me out against my will and perform surgery and they had ZERO RESPECT for me as a person and were callous and uncaring, careless, NASTY, evil... Their conversation about me was the noise that traumatized me, the noise of the surgery itself would have had no impact on me at all.

I want to say a word about "consultations." This is a code word for "charge a bunch of money for an ordinary office visit!" Dr. X, my wannabe surgeon charged me 250 dollars for the privilege of allowing him to con me into an ill advised surgery which subsequently ruined my life. I got nothing but scare tactics, the "consultation" consisted ENTIRELY of him telling me how horrible my life would be if I didn't get the surgery. He didn't listen to a thing I told him about anesthesia, prior experiences etc. For his part he failed (purposely) to tell me about risks, his lack of expertise, the fact that he only works on unconscious patients, failed to tell me of common (his word) side effects like my whole hand being numb etc. His office lied to me about the cost of this surgery as well. Maybe the whole surgery should have been free, seeing as how I was a practice dummy?

So what did I get for $250.00? I got maybe 10 minutes of Dr. X's time. I got lied to about the NEED for surgery, I was NOT told of any side effects, the site of the surgery or any substantive risks, other than the usual infection and bleeding. Since I had already refused any general anesthetic, this was never discussed. I was not willing to risk my life (and mental well being) with general anesthetic for something as ridiculous as a broken arm. The word "sedation" was never, ever mentioned at any time by anybody, here at the expensive and phony consultation or any time thereafter. Sedation is a huge secret, to be kept from the patient at all costs. Once it is done, you have no recourse... and they can proceed with other dangerous but moneymaking procedures without your consent. I guess that this is all a plan to maximize profit.

Don't ever let a Doctor get away with charging you hundreds of dollars for a "consultation." This is a rip-off. All this is for is so that the Doctor can terrorize you into accepting very expensive and risky procedures. This being so, then this "consultation" is only for the Doctor's benefit, not yours and you as the hapless patient should NOT be charged this exorbitant fee, just so the Doctor can con you! It's a freakin office visit with some coercion thrown in for good measure. Why should the patient pay for something that is only in the DOCTOR'S BEST INTEREST, not theirs?

Dr. X also insisted on taking another x ray to go along with the "consultation." This was $95. The x ray machine was obviously faulty as it was vague, grainy and there were splatter marks all over the edges of the x rays. They didn't even bother to give me a lead apron when they used this dangerous machine! The reason for the x ray? So that Dr. X could use it to show me a miniscule additional "collapse" of the fracture in order to coerce me into allowing him to get some experience doing this particular surgery. The x rays are on this site and most people couldn't find this "unacceptable collapse" with a magnifying glass. Another spurious charge designed to maximise profit. This x ray was for HIS benefit, not mine. I was understandably skeptical about his marvy surgery... I wanted a non surgical intervention. So Dr. X freely spent MY money in his quest to con me into doing what HE wanted to do, not what was best for ME!

And they wonder why health care has become so expensive? These people are searching for tricks to charge more money for ordinary things. "Consultation fee," my foot!

Chart from Dr. V

Here is the entire chart from Dr. V. (2nd opinion) Please do NOT get the idea that I dislike this Dr. in any way. He is absolutely wonderful, kind and caring. However, in trying to calm me down, he told me a story about bones shrinking and settling, (last page) this without ever having seen ANY previous x rays. I think he imagined that if he told a little white lie, that it would make me feel better. All it did was alarm me. I want truth, honesty, and full disclosure. That is how I deal with things. I don't want to be placated, I find it insulting! If my surgeon Dr. X had been truthful, if he had paid the slightest bit of attention to what I said, if the CRNA Aaron hadn't thought that I was so stupid that he could proceed against my wishes, if ANYBODY had been up front and truthful I wouldn't be here this morning typing on a computer! On this chart, besides the final paragraph, I would like to point out just how forthright I am about anesthesia. Dr. V "heard me" (loathsome term) and actually wrote down what I said about anesthesia and Versed! Do you believe that I never said a word about it to Dr. X?

Interesting FACTS about POCD and PTSD Following Surgery

anesthesia and changed mental function This study shows some alarming facts about what anesthesia does to people LONG TERM! The very facts that we patients are pointing out to our medical teams and being dismissed are actual facts. I wonder how many of the people in this study were given VERSED? They say even minor surgery can cause COPD and PTSD. What anesthesia agents are being used in this "minor" surgery? As you can see it is in the best interest of the patient to be allowed to remain awake and alert, without chemical amnesia, especially if this is what the patient desires. Notice also that the excuse that older people had disintigrating minds BEFORE being given anesthesia is also proved totally false. On the chart which shows the age group, please note which age group has the HIGHEST incidence of COPD. It isn't the older person. Also as an aside, if it were true that older people have more problems with anesthesia then why are they being given Versed? HMMM?

Finally some RESEARCH into Benzos and PTSD!

My fellow Versed/Midazolam sufferers regularly comb the internet for insightful (and sometimes horrifying) articles on the poison that created PTSD in us and basically ruined our lives. Here are 2 articles that seem to point DIRECTLY to the medical personnels' precious Versed. The same drug that medical people just LOVE is causing mental disorders later in the patients they are purporting to help! Finally some scientists and doctors are looking into this. We are all pointing our fingers at one particular drug as the source of our anxiety and mental problems and have been summarily dismissed as psychos by the medical community. It WILL be proven that the use of Versed DID cause our problems. The medical community needs to revert back to the pre Versed days as quickly as possible. No longer will you be able to pretend that Midazolam is harmless and beneficial for patients. YOU LIKE IT, it is causing us unimaginable suffering for years after the fact! Here are the links;

This one is entitled "Are we causing PTSD with our current sedation practices?" The weird thing for me is that the word "sedation" is now used to describe amnesia. If we were just sedated, by the non medical description of the word, would we be getting PTSD? Or is the drug itself altering our brain in an unacceptable (to IT) way and creating anxiety over it's use in any minute amount? We are finally going to get some studies! I have offered over and over to have brain scans to help determine which part of my brain is sending out the signals about Versed. Since I have never had an anxiety disorder before, I would like to know! They can't GIVE me this drug again, but whatever it did is still reverberating around in my head... "Vast Improvement"

Here we have it! "VAST IMPROVEMENT" Not so I would notice. I was already having major problems with at least one of the screws, and look how he dismisses my concerns! "... does not appear objectively in any way to be related to the position or placement of the screw." "All hardware appears to be appropriately positioned" Then he goes on to threaten me with Versed (which I notice he didn't mention in this letter) and general anesthetic again!!! He cannot understand why all of this might upset me! I did NOT in fact require general anesthesia OR Versed to remove these screws. Look for yourself and see if you see the that the hardware could be a problem. He knew that I had no more money for a second opinion! I was totally screwed (pardon the pun!) at this point and my caring surgeon was pretending like I was insane!

Informed Consent for Interscalene Block?

Here is one of my discharge papers. Click on it and read! At no time did I give permission for an Interscalene block. IF they actually gave it to me it would have been when I was unconscious which is much more risky. I was only willing to accept the risks of an axillery block so that I would NOT have to have general anesthetic. I find no reference to this interscalene block anywhere in my patient charts. I should NOT have learned of this by reading this paper. This should have been revealed and an informed consent obtained PRIOR to surgery. I still am not sure I got this, or was this paperwork actually for the axillery block? Why would I have this shoulder block when I had already had an axillery block and general anesthetic. I find this announcement to be in violation of patient rights law and unethical as well.

Reducing Complications from Interscalene Blocks

I also want to add that this paper was the only communication from anybody. This was yet another unpleasant SURPRISE from the medical professionals. My surgeon was long gone or unavailable when I was released from the hospital. Nobody will answer my questions about this or anything else. I also have to admit that I was completely out of control in the PACU as noted elsewhere in this blog. I accept that these people wanted me OUT OF THERE AS QUICKLY AS POSSIBLE. Not any faster than I myself wanted out...

Am I Bitter? Don't surprise me!

It occured to me that my attitude might turn some people off. I am VERY BITTER about what happened to me. The things I mention here on this blog should never, ever, be left to the patient to discover. Surprise is not a word that most people want to use in conjunction with their medical treatment. I was in for the surprise of my life when I went in for a simple broken arm.

I was surprised that my Doctor never showed up prior to surgery to explain the surgery to me. NOBODY bothered to do this for me. I was surprised, shocked and HORRIFIED when this evil poison Versed was injected into my IV after everything I said about staying awake and alert, and all the problems I have had with previous surgeries and anesthetics. I was even more horrified to find that I was rendered obedient and actually helped them give me general anesthetic which I had vigorously declined. I was helpless. More HORROR when it was explained that I didn't have a leg to stand on and couldn't complain because "you can't possibly know what happened, we gave you a little something to cause amnesia!" (actual quote from Dorothy, patient relations.) I didn't get amnesia, but this sure explained a lot of why I was treated like a sub human! Shouldn't this have been explained to me prior to surgery? Shouldn't I have been able to say no? I specifically declined any drug like this, but here is another quote from Dr. B "If you had known what Versed was, you could have declined it." Well, I did decline anything that would incapacitate me or anything that was debilitating. Doesn't that cover Versed? I said that I wanted to be awake and alert and watch the surgery. Does that include Versed and general anesthetic? Why would anybody think that it's OK to do this to a person? I wasn't nervous or apprehensive! I had open reductions on my Femur TWICE without any Versed or general anesthetic.

Waking up to find that my hand was numb, my thumb didn't work, my upper arm was in excruciating agony, and there was an incision straight through all my tendons was a horrible surprise. Of course my Doctor was unavailable following surgery as well. I was left to discover just what had happened all on my own. I am still trying to figure out why this is so. Am I supposed to just trust the Dr. to do whatever he/she wants, and not care about the consequences? Does it matter that I needed my hand to work as I am really active? Am I supposed to just be grateful that my wrist is MARGINALLY straighter regardless of what I had to give up in soft tissue function? (Not to mention the PTSD which is pretty profound. ) What would be the point of concealing all of this? It's against patient rights laws, but I am trying to figure out the mental process by which medical people decide that the patient doesn't matter, just performing surgery, the devil take the consequences.

Can anybody else imagine the TERROR of knowing that your arm is screwed up, and there is NO WAY IN HELL you will trust anybody in the medical field again? I KNEW the surgery was bad. I know my body better than anybody else. I could feel the screws tearing at my flesh and I knew what could happen, but there was NO WAY I was going to go through the indignity of another surgery at this same hospital, and no way was I ever going to go through the mental disintegration of Versed for any reason, even to save my wretched life! I had my first panic attack in my life right there in Dr. M's office when he told me that not only was he NOT going to take out the offending hardware, but that even if he did, that I would have to have Versed and general anesthesia again as he doesn't work on conscious patients! OMG!!!!!! Why didn't he tell me that all of this would take place BEFORE I was stuck with the porcupine device in my arm? Dr. M never mentioned one single word about this in our expensive "consultation!" I was so terrified I wanted to steal Novocaine from my dentist's office and attempt to take the screws out myself. I don't want to be a cripple! I was completely unprepared for any of this! I couldn't believe that somebody I trusted to HELP me would damage me this much and conceal the horror of it all so that I would let him operate...

I still have not received any answers to my questions, only attitude from everybody involved. I didn't start out with my nasty attitude, it congealed from 3 years and more of trying to get answers. Originally I was hurt, devastated that these people thought so little of me personally that they felt confident smashing into my brain and body without permission and without telling me the true results of the surgery or the anesthetic. I am such low life SCUM that my wishes don't matter? I am too STUPID to decide for myself whether I wanted all this? I am too IGNORANT AND UNEDUCATED to be given any information because I "wouldn't understand it anyway?!" Am I so UNIMPORTANT that the surgery should be performed like you see on this blog? This particular site has been a gold mine.

Elsewhere in this blog I have shown little self tapping purple or magenta screws sticking out into "who knows what" in my forearm. Well, here is the exact same screw right down to the color, in somebody else's arm. LOOK WHAT JUST THIS ONE SCREW DID!!!!! I need to get in to a Dr. as soon as possible and have this checked out! I had 3 of them sticking out between 1/4 and 3/8's inch minimum. These are clearly visible in all the x-rays here on this blog, and I show them on a fake skeleton arm here as well. Is this something Dr.s routinely do in order to minimize their culpability? At least this one finally took her seriously and didn't just summarily dismiss her like mine did.

Found this recent study on ORIF

Complications of Volar Plating My Dr. didn't believe that this stuff could happen. Even when he saw my x-rays and heard my complaints, he still didn't respond to it. My case is not in these kinds of studies because my Dr. doesn't believe there were any problems whatsoever with his surgery. He was fine with my loss of grip, numbness, thumb not working, pain, screw sticking up almost out of the skin, the shredding of my muscles and tendons, loss of mobility in my wrist, this is all just fine because the bone is marginally straighter. he seemed shocked that I would complain about the surgery. He acted like I was nuts to think that he should have revealed all of this PRIOR to surgery. He made sure that he never saw me in the hospital, being over an hour late for surgery and I wonder if this was a ploy to avoid having to answer any questions? He wouldn't take my calls in the days preceding the surgery either. I thought he was just busy, but NOW after everything, I have my suspicions. Nobody will answer any questions for me and the next two surgeons were busy making excuses for Dr. M. If all these bad outcomes are common, as shown in this study, then why wasn't I made aware of all this so I could make a decision NOT TO HAVE THIS SURGERY UNDER ANY CIRCUMSTANCES. I NEVER WOULD HAVE AGREED TO THIS SURGERY BECAUSE OF THE EXTREME RISK INVOLVED!!!!!

Where is the new legislation in this "Health Care Reform" bill to prevent what happened to me from happening to anybody else? Where are the huge fines for violating patient rights? Where are the criminal statutes for deliberately defying patient rights laws? Where is the mediation for the enormous hospital bills these people run up while disobeying patient wishes? Where is the legislation forcing hospitals to be responsible for patient rights while in their facility? Where is the pricing transparency like they have for auto mechanics? Where is the legislation forcing anybody in the health care field to be randomly drug tested? Where is the legislation for ensuring that health care providers are mentally competent to provide care for helpless people? Where is the legislation providing for mediation or arbitration? Is it OK to treat people like I was treated so that the medical people can suck the last dime out of our whole economy? We patients are absolutely helpless!!!! We aren't being treated like humans at all and all our politicians can talk about is TORT REFORM? What the hell. Why can't I be held harmless for any careless, reckless thing I may do? I don't like paying so much for liability insurance on my big rig! (Everybody knows big rigs have good insurance and deep pockets!) I have to pay huge additional insurance lest I harm somebody's property when I make a delivery as well! I don't want to pay home owners insurance in case somebody gets hurt on my property through no fault of my own! Where is the legislation CAPPING THE COST OF HEALTH INSURANCE? Oh hell no, we are only going to help out the rich Doctors. They don't want to pay 20,000 of their million dollar salary for malpractice insurance do they? (so what if I do as a moron truck driver!) They don't want to be held responsible for directly defying patient wishes. They want to make sure they have an unending supply of helpless people to injure further.

How it all started

Here is the original x ray from the clinic. Yes it is a bad break, but to say that it could only be treated surgically is a lie. If I had known then what I know now after years of research, I would have taped a golf ball under my wrist at the break and wrapped my arm so that the hand was pulled slightly under and down. I bet I would have been a lot happier and I would have retained hand function. I also bet that NONE of what Dr. M threatened would have happened! Unbelievably I found this link showing that what I wanted was NOT unheard of! Distal Radius

Here are the notes from my surgeon. I have NEVER SEEN A PATIENT CHART, just these notes written to the nurse who sent me to this Dr. This is against the law, but all I have are these notes. I want to show how inaccurate this can be. In the very first sentence, where it says I had a "fall from a horse?" This is inaccurate. I repeatedly stated that I had been knocked down by a horse. Big difference. On the second page it says that "...the fracture has settled further with an increase in dorsal tilt and dorsal collapse of the fracture leaving an overall unacceptable reduction." Unacceptable to whom? There WAS a barely noticable tilt, in the x-rays, but this was acceptable to me! However, using scare tactics and complete lack of pertinent information of was manipulated into having this surgery.

Here are the scare tactics; "...if this injury is treated non-operatively without any attempt at reduction that her wrist would likely go on to heal with considerable deformity leading to subsequent chronic pain and stiffness and posttraumatic arthritis of her wrist." (He also mentioned in another letter that he told me I would never work again in my profession if I didn't have this surgery. I'll put that up on this blog as well.) I wish he had tried this first. Maybe there isn't enough money in this?

At the top of the second page which contains this statement, read where "Other than the swelling, she does not have any visible or grossly palpable deformity at the wrist." So how come it would "go on to heal with considerable deformity?" On the first page it says "She has normal sensation and motor function in the radial, median and ulnar nerve distributions." This is not what I have now, due entirely to the surgery.

Also of note is this "Physical exam reveals a 51 year old female in no urgent distress. Her mood is pleasant, and her affect is appropriate. She is alert and oriented." This description is consistent all the way through every single chart, from the Dr's office to the hospital intake. "Pleasant woman in no distress" is what the hospital personnel said. I have not been the same since this ill advised surgery. Not physically nor mentally, nor financially.

Nothing in here about me declining general anesthesia. Nothing in here about me being "crazy to start with." Nothing in here about the severing of tendons, screw placement causing tendon rupture, nothing about where the incision was going to be, nothing substantive about the surgery, repeated surgeries, just the threats of chronic pain etc.

Later on this Dr. claims that he gave me a "choice" of having the arm reset in his office. Look what all he says in his statement. He never offered me this choice, just mentioned that if he tried something like that, that it wouldn't work anyway.

I was uninsured as my employer didn't offer health insurance. I wanted external reduction, not surgery. Did you note that an "external fixator" is never mentioned? He only told me about that option after I was in hysterics over the poor outcome of the ORIF. Yes Dr. M offered to let me pay in payments, but his office misrepresented the cost of the surgery, to the point that it is just impossible to pay off. If they had told me the truth, I would NEVER have consented to this surgery based on cost alone! (not to mention the horrible consequences of the surgery and the forced anesthesia!)


I made 12,000 dollars in 2006 and my cost for a 70 minute operation was more than I grossed for that year. Angry about it, you bet. I am a conscientious consumer and I keep my bills under control. They had no right to quote me one price and then pad it by thousands of dollars. How am I to manage my finances with this kind of thing going on in the biggest expense after housing? This whole surgery was completely unecessary, and way too expensive for a poor truck driver.

Dr. X X-Rays

This is the original break. I had straightened it out myself before my little girl saw it and freaked out. Looks fairly OK. ( I accidently flipped this x-ray.)

Here are the first x-rays taken after the surgery. I had to FORCE MYSELF to return to the Dr. I was very upset by the assault with anesthesia drugs, the numbness, my thumb didn't work, my upper arm was a throbbing agony from the tourniquet, and the incision was straight through the tendons on the tender underside of my wrist, screws sticking out of the bone everywhere! This was all completely unexpected. It felt like a cheese grater was in my wrist joint. Very painful. You can also see the styloid fracture of the Ulna which was left untreated.

A little over a month past the surgery. I was still complaining about all of the above and the pain and swelling in my wrist joint. I could see and feel the tip of the longest screw sticking up from my wrist. I imagined that if I pressed down on the bump, I could create a hole in my skin with the screw tip. I was paranoid about infection, this screw giving me arthritis, this screw wrecking my wrist joint and cutting my tendon to my thumb... These are also from Dr. X's office. I complained and he fired me as a patient.

The last x-rays from Dr. X 7/12/2006. You can also clearly see the "locking" screw protruding out of the bone and into the bottom of my wrist (volar aspect) in this x-ray and the previous one, along with all the screws sticking out into my forearm.

X-Rays Showing Placement

Compare this to the one from Dr. M's office... The bones have NOT shrunk, settled, or anything else. This is how they were placed in the original surgery and this is how they remained until they were removed.
In the first x ray you can see the "proper" placement of the screws. Note the "barely palpable" tip of the longest screw. This is also visible in "Dr. M's X-Rays" in the same exact position! These x-rays were taken a year and half after surgery. I suffered with this stuff in my arm shredding who knows what for that long.
Here is the x ray from a slighly different angle. Dr. V had these taken because I was complaining about it and he took me seriously.
Doesn't this look comfortable? Am I hysterical and imagining this? Look at all the screws sticking out! Dr. M said that this is fine, that these can stay in my arm forever. These screws have not moved one single millimeter! See the x-rays under "Dr. M's X-Rays"

Pleasant woman in No Distress

In the report below please note under "General Condition: No distress." Also note when this document was allegedly signed. 10:00. The surgery was to start at 9:30. Why am I being evaluated at 10:00? At 10:00 I was already struggling to fight off the Versed. Also, quite contrary to every other piece of paper, my wrist is described as having "sig. deformity." This is the only time that my wrist has been described thusly. Everywhere else, there is "no visible or palpable deformity" and only "mild to moderate edema."

In the report on the right it once again states plainly "GENERAL: She is alert and oriented to person, place, and time. MOOD PLEASANT. Affect appropriate. She is in NO DISTRESS." (italics mine) So why was I given Versed? This also substantiates my claim that I was just fine before surgery.

Here we have an assessment of my mental state. Please note that none of the boxes are checked with a "Y." I wasn't anxious, depressed, didn't have ineffective coping, cognative impairment, I wasn't withholding information, had no attention seeking behavior, no disruptive behavior, no delusions/hallucinations, no potential for self inflicted injury, no other, etc. The only one marked is this one "Do you feel concerned for your safety at home? "N" Funny I was just fine here, but AFTER surgery I was obviously a nut case... I have no cognative impairment, but oddly one of the CRNA's said that I had "moderate understanding" along with "anxiety."

I am going to show medical records in here which show that I was a pleasant woman in no distress. You can tell by the tone of this blog that this is no longer the case. I will also show how I woke up. I will point out glaring deficiencies in these reports. They are from the day of surgery... Here we have on record from the hospital that "The patient is a pleasant 51 year old female..." Also of note is the erroneous statement that I sustained a "fall from a horse landing on her outstretched left wrist." This is all wrong. I was knocked down and then rolled over my arm in an awkward position! I didn't land on my outstretched wrist. Here it also shows that we had "SIGNIFICANT discussion of the risks, benefits, and alternatives. NOT TRUE! It was never revealed to me all the problems with this surgery, or the fact that this Dr. refuses to work on conscious patients. He didn't even tell me where the incision was to be. Silly me I imagined an oblique entry rather than slicing through my tendons. The alternative of an external fixator was never mentioned. The loss of the use of my hand was never mentioned. The risks of tendon injury from the devices was never mentioned. The benefit was supposed to be that I would work again... More on that in another post. Here I am, a pleasant female without history of depression or anxiety. Also of note, my descriptions of problems with anesthesia are not shown. I guess that paradoxical reactions are just a problem for the patient and not worthy of mentioning at all.

More incomplete charting and more lies

Here is the preoperative report. Note that it says that I have no history of problems with anesthetic. This is a lie. I went into great detail about my paradoxical reactions to anesthesia, my previous 4 open reductions of my femur 2 without general anesthetic (none with sedation), the reasons why they did it that way, right down to the hair loss. This is completely missing from my chart. They only list my tonsillectomy (my bad paradoxical reactions not even mentioned although I told them all about it!) and my c-section, for which I was NOT knocked out! I explained in graphic detail all the problems that I had with the first 2 femur surgeries when they used general anesthetic, along with the fact that I had an epidural and stayed awake and chatting with the operating team the whole time the last 2 times. I told them that the anesthesiologist for the femur surgeries said that I fought them the whole time under g/a. He was more than happy to have me awake. Why do you suppose that entire conversation and any allusions to it or a broken Femur are missing? HMMM?
I don't have ALLERGIES to anesthesia. I guess paradoxical reactions, waking up in restraints, depression, hair loss etc. are the patients private problems, not a problem for health care providers! They could care less. If you do not die, then it's just ducky with them.
Look what Aaron put at the bottom. "Alert pt. prior to GA if necessary." I didn't say to ALERT me. I said we would have a discussion about how best to proceed if THEY thought it would be necessary. I informed him that an additional local anesthetic such as procaine or pain medication would have to suffice. AT NO TIME DID I GIVE PERMISSION IN ANY WAY SHAPE OF FORM FOR SEDATION OR G/A! I TOLD him that general anesthetic was NOT going to be necessary, that we would just have to figure it out if the block didn't work. What I didn't say precisely (not that it would have worked) the magic words "under no circumstances." I thought that a simple "no," along with not signing an informed consent (or any consent) for this kind of anesthesia would suffice. I would have signed out AMA before I risked death etc. for a stupid broken arm. The Versed prevented this...
It also states at the bottom that the "Plan and Risk of Anesthesia explained to the patient/guardian; understood and accepted. This is a false statement. Yes they explained that they desperately wanted to give me general anesthetic, but I vigorously declined this! How dare they simply state this as a fact! Where is my signature stating that I accepted this? What risks were explained? I don't see any risks outlined! The hospital was cited for this. What about the risk of DEATH just to fix a broken arm? What about the risk of brain hypoxia and PTSD from their sedation. See anything at all about SEDATION?
Also on this page is an "Evaluator Signature" Who the hell is this now? Nobody knows. This is in violation of patient right laws which state that the signature must be legible. It also violates the law in that this person was never explained to me, he and his job are not listed as one of the people involved in my care. Course there is no list at all about anybody... The hospital was cited for this one. I have a right to know who is performing any tasks.
I also want to point out that nobody offered me a Bier block. See the boxes in the corner. This is the block I had to remove the hardware before I became a cripple. The Bier block worked PERFECTLY! There was no need for the dangerous and inconsistent Axillary block! No "need" for general anesthetic and positively, absolutely, no need for Versed. It is as a direct result of being poisoned with Versed that I had this horrible, unnecessary and controversial surgery at all.
Also note that the DATE is wrong. Could this be a replacement chart? It is dated the day AFTER surgery. I wasn't anywhere near this place on that date. My age is also erroneously listed as 55. I won't be 55 until next year and this was 3 years ago. I am also NOT 15'6" tall. My goodness that would be some kind of trick wouldn't it? My records are replete with false, manufactured, erroneous, incomplete and incorrect data.

Medical Records Omitted

In my chart from the hospital there should be a graph of my heartbeat and respiration. I have a piece of one that shows a sharp drop to the bottom of the chart, but I can't read it. Could I have been walloped with Versed to the point that I now have brain hypoxia? I warned them that I have paradoxical reactions to anesthesia agents, were they trying to knock me down? I wasn't the slightest bit nervous or anxious prior to the Versed injection, but who knows what happened once they totally disconnected my brain. My memory is clear right up to the point that the CRNA took out my partial and shoved a tube down my throat. Is this when I crashed? I am including this chart here. This is also the chart which contains the fact that I was given an additional 4 mls of Versed post surgery. I was in the hospital for 7 HOURS for a 70 minute operation. My BP crashed to 80 over 30 for half an hour. They gave me 1400 cc of "Crystalloid" why is that? Here is a studySecondary Abdominal Compartment Syndrome After Severe Extrem... : The Journal of Trauma that shows how dangerous this is. What is 10cc of EBL? Why did the anesthesia stop so long after the surgery? Why in the hell was I given anesthesia at all? I wanted a nerve block and pain meds. There is absolutely no excuse for this! I had 2 mls of Versed preop, apparently 1 more ml at the start and 4 more before being carted to the PACU. They charged me for more, but since they refused to release my medication chart I have no idea. They don't show the Propofol injections, the timing of the Flurane gas, Benadryl, or any of the rest of it. I have no EKG charts, nothing.

Motion for Summary Dismissal

My case was thrown out of court even though I could prove negligence and harm. I have already gone over the singular problem with getting redress for my assault with grievous bodily harm. Nobody wants to take these cases. apparently GW passed some kind of law making it nearly impossible for us patients to use our civil laws. There is a movement afoot to protect doctors and nurses from prosecution in Katrina type disasters. They were so upset that they got caught giving patients Versed TO KILL THEM BEFORE THE DISASTER STRUCK that they have conned our elected officials into giving them immunity for this kind of murder.

If you are in the health care field, do not bother posting and saying that these kind people were just trying to help. Do not even try to argue that they used Versed and an opioid. Versed alone in sufficient doses will kill you. That's why you have to be trained in airway management before you can inject Versed. In fact Versed is such a potent poison that you can only use the tiniest amounts and even then you must inject it slowly in order not to kill the patient. I don't care how many other drugs can kill people, this one is the worst of the bunch.

Anyway, my case was thrown out because judge Lansing Haynes said I didn't prove "causation." You would think that that meant the my case had no merit and deserved to be thrown out, wouldn't you? Actually it means that judge Haynes gets to sit up there and claim that since you didn't pay an expert witness their 25,000 dollars, that the case has no merit. You can bring in all the proof that you want, x rays, letters, medical reports etc. and it won't do you any good. You have to have deep pockets to get justice in this country. This judge very clearly stated that I am to be held to the highest standard of attorneys, representing myself. ( remember I am just a moron truck driver) The Dr. gets to slide. He is not held to a standard at all. The Dr. isn't held to any procedural deficits in his care, but the truck driver trying to get justice for an attack IS!

I had to sit quietly and listen to the attorney for the defense, Mr. Sestero go on and on about how Ms. Murray ADMITS that the anesthesia provider was not an employee of Dr. M and that Dr. M had no control over him. (the LAW says otherwise) I couldn't believe my ears! Then Mr. Sestero went on about the second Dr.  I saw trying to convince me that the screws had come out of the bone because of this "bone shrinkage" or "settling." The rest of Dr. V's statement was that he hadn't seen the x rays of my arm immediately after the surgery, or from Dr. M's office which clearly showed that this is exactly how Dr. M installed them. There was no change, no shrinkage, no settling. Either Dr. V was deliberately trying to protect Dr. M or more likely (I hope) Dr. V couldn't BELIEVE that another Dr. would be so careless as to install these screws like that.

Judge Haynes didn't allow me to read THE REST of Dr. V'sstatement where he admitted that he had never seen the previous x rays. I asked. There were also many many inaccuracies in my medical records which I was not allowed to address. I guess whatever lies Dr's put down in their reports are gospel. Since when have Dr's never told a lie? Seems to me they lie A LOT!

I was allowed to read the laws which pertain to "informed consent" into the record, along with the laws which clearly state that regardless of the anesthesia nurse not being an employee of Dr. M, that Dr. M IS, BY LAW, IN CHARGE OF THE ANESTHESIA NURSE. I heard Dr. M order Aaron to "put her out." He WAS in charge of the damn arrogant little nurse. It's the law, and apparently not even the attorney for the defense knew the law. You still think that they care? They don't even know the law, and why should they, it didn't matter anyway.

As a small consolation I observed Mr. Sestero making notes as I was reciting the laws in court. I hope he was writing down what I was citing for future reference so that nobody else has to sit there helplessly and listen to the attorney for the defense make their case for them, after the judge has ruled that there is no case. Mr. Sestero by his own testimony in court showed that the laws had been broken and that there was complete ignorance of the law, seemingly even by himself, a "super lawyer." Ignorance of the law isn't a defense for us normal people, but it is for the exalted Dr.s.

Mr. Sestero brought up that my regular Dr. put in my chart that I had been previously diagnosed with PTSD! This was quite a surprise to me. I remember him asking if I had ever heard of PTSD and I said yes I had heard of it. He said that is what was wrong with me now. I never said that I had been diagnosed with this before! It doesn't matter anyway because Dr's are infallible truth tellers. Don't ever take for granted that what is in your chart is true and accurate. You have the right to amend your chart. Take advantage of this and regularly check. In my case the clinic that I go to refused to allow me access to my chart, in violation of the law. Is this just one more law that nobody knows about and nobody enforces? I had to purchase my records or pay for a doctor to go over them with me. They feel it would be too upsetting for an "untrained" person to view their chart, but it's OK as long as I PAY to look at them. I listened to this dumbfounded. How can I ever trust another medical provider?

I brought the skeleton arm with the hardware that my doctor installed as shown in another post, all the x rays, medical reports on how the surgery I had is best performed the way I wanted it with a nerve block instead of with general anesthetic. I brought excerpts from medical journals showing where Dr. M had gone wrong, the proper placement of screws, warnings about revealing possible tendon injury to the patient etc. I brought Dr. V's ENTIRE statement. I brought the medical records from the Dr. that took the implants OUT of my arm, without Versed or general anesthetic. I brought copies of all the laws that were broken by Dr. M and the rest of the staff. I brought copies of the citations from the Idaho Board of Health and Welfare. I wasn't allowed to use any of it. It's PROCEDURE that matters not substance. You either pay somebody tens of thousands of dollars to state the obvious for you or you are out the door.

The attorney for the defense didn't seem to know the law as it pertains to "informed consent" documents. He seemed to have no clue that the alleged informed consent which I had signed was actually not legal. It didn't contain all the things required by law at all. It actually only had the first 3 things, my name, the name of the procedure, and the Dr's name. The whole rest of the document was in violation of patient rights law. Even the way it was obtained was illegal. Did it matter? Hell no. JUDGE HAYNES REVEALS THAT MEDICAL PROVIDERS DO NOT HAVE TO FOLLOW THE LAW, AND IT DOESN'T MATTER IF YOU HAVE BEEN INJURED BY CARELESS ILLEGAL ACTS BY MEDICAL PROFESSIONALS. RES IPSA IS MEANINGLESS! Any questions?

My case for summary dismissal was heard on September 3rd 2009, at 10:00 in Judge Lansing Haynes courtroom at the Kootenai County Courthouse in Coeur D'Alene Idaho. I assume that this is public record and anybody can research it or get a copy. As soon as *I* get a copy I will put it up here.

Versed, Stress, Drugs and Hair Loss

One of the odd things that nobody in the health care field cares about is HAIR LOSS. You have heard about it with cancer drugs, but did you know that this is a common problem with any number of drugs? I have not been able to find any studies on this but for me and some of my friends, anesthesia causes hair loss. Maybe it's a symptom of being poisoned? I have also found references to drugs like Propranalol (Inderol) mentioned elsewhere in this blog causing hair loss. Do you wonder, like I do, what other things are going on in your body subsequent to being poisoned? If these drugs cause hair loss are they also causing more hidden problems? Can they cause sloughing of cells in saaay your BRAIN! How about kidney function? Heart problems?

For myself, every time I have had general anesthetic, I end up with hair loss. On the one hand, I have tons of hair, so I haven't gone bald, but on the other hand my luxurious thick hair has always been my signature. Ever since I the Versed incident I have had a huge die off of hair follicles. Three years later my hair is getting very thin. I have to get it cut in shorter and shorter styles. In another couple of years I guess I will have to wear a wig. My long beautiful hair clogs the drain when I wash my hair. It clogs the brushes I use and it even clogs up my vacuum cleaner. My hair covers my pillow when I get up. Maybe this is just ducky for health care providers, but it isn't just fine with me. Anything that kills off the scalp is not something that should be injected into patients on a whim.

ALL patients are being over medicated these days. There is no reason to use Versed for the convenience of the staff. There is no excuse for using general anesthetic for minor procedures. They can take their Propofol and stick it as well. I can see maybe using some of this ( EXCLUDING VERSED!) for open heart surgery, but for dental work, fractures and colonocopies? Are you kidding me? My body has been poisoned and it is showing itself by hair loss, memory loss, anxiety and obsession with the drugs in particular Versed. Versed is not safe, short term or long term. Not even for your hair!

Nurse Jacqueline's role

I honestly thought that the nurse Jacqueline was on my side. I even called the hospital to thank her. I thought that right up until the time I read the intraoperative report. Those bastards gave me 4 MORE MLS OF VERSED AFTER THE SURGERY WAS OVER!!!!!! What the hell were they thinking? What is the point of vandalizing my brain again, with a HUGE amount of Versed all at once AFTER SURGERY? Did they take heed of my paradoxical reactions only to the point of drugging me further? Why did they do this to me? This wasn't just one bad actor in this particular medical clinic, it was "standard of care" to deliberately and maliciously drug people. Is it that giving me this much MORE Versed would keep me in the PACU longer? More money for the hospital? There was no reason to do this to me and it didn't work anyway. I woke up in a towering rage, LOOSE IN THE PACU! I was trying to attack people! My own husband says he was scared of me too, when you guys went and got him! Jacqueline, I trusted you! I thought that you were my advocate! When you were laughing at my distress, I thought you were laughing because the nasty little CRNA was going to be in trouble! The horror of this will stay with me the rest of my life! Is this why you got into nursing? So you could traumatize people and laugh at their unhappiness? How could you do this to me? YOU, JACQUELINE, are the one who injected this enormous amount of ADDITIONAL Versed into my IV! Why? Was I already out of control, just like I warned you about? Why didn't you tell Aaron (CRNA) to shove it? You were there, was I fighting the general anesthetic like I told you I would? Is that why my surgery turned out so badly? I didn't even have one person on my side. Apparently even you, my favorite nurse, were only to happy to inject me with poison. I know you have seen this reaction before. Didn't you care that my life as I knew it would be over? I am crying as I write this, I hope you are happy.

Nurse Jill's role

If you are under the impression that the OR nurses are on your side, think again. My nurse Jill, listened to my litany about prior surgeries, heard my demands for a NERVE BLOCK ONLY, heard me say repeatedly that they were NOT to give me either incapacitating drugs, or any general anesthetic. She heard me warn the smirking CRNA that he would not be happy when I woke up if he tried any funny business. Jill heard the CRNA describe Versed, excuse me "Vitamin V" as simply a muscle relaxant. Did she warn me that he was pulling a fast one? Did she describe amnesia or forced cooperation? Hell no. This individual Jill, went right on ahead and squirted 2 mls of this poison into my IV knowing full well she was in violation of every single patient rights law, not to mention that what she was doing was unethical. Jill didn't give a rat's patooty about my rights. This is the same Jill who tricked me into signing a "surgical consent" by pretending it was just a blood transfusion consent. She was pretty pleased with herself when she snatched the blood products consent away from me. That's right, she nearly ripped it out of my hands. She happily announced that I had signed in the wrong place, but didn't give it back. When I looked at it months later I saw that SHE, JILL, had made a little star mark for me to SIGN IN THE WRONG PLACE! What kind of people work in medical centers these days? She also signed that she had witnessed "THE CONSENT." What she witnessed was me singing the document in the wrong place at her direction. This is just fine with everybody. Business as usual. They know what's best. Most people love Versed. Most people are happy to wake up and find it's all over. Well, JILL, this attitude went out of favor in the 1960's. I realize that you are too young to remember all this, but don't they teach you anything in nursing school?

Before you read the following posts...

Before you read the next 3 posts I want to tell you this. I have all the x rays to prove my point. ( I am going to try to scan them here as well.) I have the x rays from the hospital where this surgery was performed, I have them from Dr. M's office and I have them from another Dr.'s office. I have the correspondence from Dr. M showing how he dismissed my concerns and concealed the effects and after effects of this surgery. He also concealed the fact that he was going to force me to have general anesthesia. Here is an article claiming superior results with a nerve block instead of general anesthesia. A nerve block with pain medication was exactly what I gave permission for. journal of Anaesthesiology Clinical Pharmacology -Regional block best for distal radius repair He even claims to have no idea what Versed is although he fully expected me to have amnesia about the event and to be able to lie about what really happened. All documented. I have the citations from the Idaho Board of Health and Welfare. These are a matter of public record. I have all the laws about informed consent at my fingertips, and you can find many of them here on this site! Nothing that I have said is untrue. Everything that I have said is provable. I am not doing this maliciously, but as a public service. Nobody should get the surprise of their life like I did. Even murderers deserve better than what I got.

Bad anesthesia and bad surgery

Here is snapshot of what was in my arm. The screw on the bottom was by far the most painful. I thought it was because my Ulna was also fractured, but surprise, surprise, once this stuff was out of my arm, most of the pain went away. Lucky me because it was excruciating! One of the "LOCKING SCREWS" was sticking out the tender underside of my wrist right into all those tendons!!! ( here is a problem with nobody answering my questions... That most distal locking screw head that is loose (confirmed by Dr. who removed this hardware) isn't covered by the remnants of the quadrate pronata and actually is cutting the tendons or is it covered by the tattered remains of the qp and only causing more damage to it? The purple ones and the gold one are in other pictures as well. No wonder I am half crippled now. This was the worst surgery ever. I was never warned about Dr. M severing my Brachioradialus tendon, never warned that my thumb wouldn't work, never told that there is a 50% complication rate, necessitating further surgery, not informed that by fixing my bone that I would sacrifice my hand! I am still facing reconstructive surgery for the partially ruptured tendons, Two Case Studies of Patients with Flexor Tendon Injury Following Locked Volar Plating and my hand is turning into a claw. I was never warned about the numbness, 70% loss of grip, the crushing of my upper arm by a tourniquet. My upper arm muscles have never been the same either, simply because of careless application of crushing pressure. I will never do any heavy lifting again because Dr. M severed the brachioradialus and the next Dr. had to sever it a second time. I can't ride a high strung horse, use a shovel, ride a snowmobile or ATV, do any rock climbing or pick up a child because my hand and arm don't work. They don't tell you about this when you "ELECT" to have this surgery. I would never have consented to this kind of surgery if I had been told the truth. The law says that they must reveal these things, but they don't! They want your MONEY! My feelings on this are that I was mugged, drugged, raped and physically harmed by this Dr. and all of his minions. The anesthesia was forced on me, I am am still in counseling for the Versed induced PTSD and my hand and arm are permanently ruined. The cost for this was about 14,000 dollars. Then I had to pay for more surgery, a kidney infection, counceling and drug therapy. Bad anesthesia and bad surgery. I wish I had just gone home. Never have this surgery!!!

This is a copy of my implant record showing the extreme length of the screws involved. My wrist is about 7 inches around at the widest part of the Ulna and dorsal ridge of the distal Radius. Where it broke is presently 6 1/2 inches. My arm at its most distal is about an inch and 1/2 tall (maybe a little less) measured from volar to dorsal where a watch would go.
Here are some more screws sticking out into the soft tissue of my forearm. Every time I moved I could feel these ripping and gouging the muscles!, Extensor pollicis longus muscle - Wikipedia, the free encyclopedia These are exactly the height shown and measured in the x rays from Dr. M'soffice and later x rays from another Dr. The second Dr. tried to convince me that my bones had shrunk and settled causing this. Too bad he never saw the first x rays. Dr.s will lie for each other. (Even if this was true, where is the informed consent outlining this kind of problem with this surgery? You can really see the gold screw where Dr. M drilled straight out into my wrist. You could actually FEEL this gold screw under the skin it was out so far. Dr. Mpicked the very longest screws possible even though my bone structure is very small.
